SHED Men's Health Legal Information
General
The following terms and conditions apply to all transactions on www.shed-mens-health.co.uk. The use of this internet website indicates your acceptance of these terms and conditions. Placement of a electronic order confirms your acceptance of these terms and conditions. You must be over 18, have a valid debit/credit card and be able to accept global delivery. This does not affect your statutory rights. Please print a copy of this document for future reference.
1. Definitions
In these Terms and Conditions the following expressions shall have the following meanings unless the context otherwise requires.
“SHED” or “SHED Men's Health” means the retail e-commerce Internet site www.shed-mens-health.co.uk.
“The Goods” means any goods or products supplied to the Customer by SHED in accordance with these Terms and Conditions.
“The Customer” means the person, firm or company who places an order for supply of the Goods.
“The Purchase Order” or “The Order” means the electronic order (placed via www.shed-mens-health.co.uk) given by the Customer and accepted by SHED for the supply of Goods.
“Delivery” means the delivery of the Goods from SHED to the Customer. Please read our delivery section for full delivery terms and any costs.
“The Price” means the advertised product price for the specific Goods as detailed in the Purchase Order, to be paid by the Customer to SHED. The Prices advertised are inclusive of any Value Added Tax payments that may be due.
“The Invoice” means the invoice relating to each specific Purchase Order.
“Payment” means the payment by the Customer of the Invoices rendered in accordance with these terms and conditions.
2. Terms of Payment
Payment for goods requested shall be made electronically by the customer at the point of order via www.shed-mens-health.co.uk.
Payments are handled by using either of our secure payment server partners, Pay Pal and Google Checkout.
3. Refunds and Returns
The customer is entitled to a full payment refund up to 7 days from the date of delivery, on the basis that the goods are returned in perfect saleable condition in their original packaging. This refund does not include the sender's postage costs.
If you require a refund you must contact us with your order details within the 7 day period. Contact details are at the base of this page.
In the event that a product is faulty on delivery, we will replace the item free of charge when we have received the faulty unit back. We do not cover the cost of the senders postage charges.
Any electrical appliance that develops a fault after the 7 day period after delivery but within it's warranty period, will need to be dealt with by the manufacturer under warranty. Please see your warranty card for the relevant contact details.
Charge-backs will not be accepted through Pay Pal without mediation. If there is a problem with your order, please contact us directly and allow us to solve the problem. If this mediation does not solve the problem we will refer to Pay Pal dispute to act as an independent mediator.
Due to recent fraudulent behaviour in the e-commerce market place, we monitor all of our orders to identify signs of fraud. In the event we believe a fraudulent transaction is attempting to occur, we reserve the right to cancel the order without reason or explanation, contact the relevant authorities and supply details of the transaction. We may potentially track the IP address of the transaction.
4. Pricing
The purchase Price for each product is as advertised on www.shed-mens-health.co.uk.
SHED reserves the right to be entitled to reasonably amend any confirmed order or product Price to reflect any typographical errors, or errors and omissions created due to e-commerce system issues. We will contact you if this situation should occur and offer you the right to cancel your order or mediate to an acceptable mutual conclusion.
5. Delivery
Delivery Rates:
Mainland UK - 3.00 GBP for orders under 50.00 GBP. Free for final order values above 50.00 GBP.
Non mainland UK (Northern Ireland and North Scotland) - 10.00 GBP.
Channel Islands (Jersey, Guernsey, Isle of Mann and Isle of Wight) - 12.50 GBP.
Republic of Ireland - 20.00 GBP.
EU countries - 20.00 GBP to 25.00 GBP depending on location. Delivery quotes for specific EU countries can be obtained on the shopping cart page.
For delivery costs to Non EU countries, USA and R.O.W please contact SHED at info@shed-mens-health.co.uk for a quote.
The provider and method of delivery will be at our discretion and will be based on order value and the security level needed. All packages will be suitably re-enforced and made secure before delivery.
SHED use Royal Mail, Parcel Force and Business Post/UK mail as standard couriers.
If you do not receive your goods within 5 working days please contact customer services with your order number on 01473 430117 or via email at info@shed-mens-health.co.uk.
In the event of a parcel and it's contents being damaged on delivery, please take pictures of the package and email them to us at info@shed-mens-health.co.uk with the damage details. We will then send you out a replacement package and follow up the matter with the courier service.
SHED aim to have deliveries carbon neutral as soon as practically possible.
6. Product Descriptions and Images
All images, descriptive material and specifications on SHED are to give an as accurate as possible description of said goods. We endeavour to faithfully represent the manufacturers products and branding. Full detailed specifications are available from the respective manufacturers web site in the event of a lack of specifications.
All product images used on SHED have prior expressed permission from the respective manufacturers and distributors. Please obtain permission from the manufacturer before copying any of our images and infringing any copyright laws.
We aim to keep all product information and images as up to date and accurate as possible, but SHED cannot completely guarantee all information will be completely accurate, and deny any liability that may arise from this.
7. Inventory
In the rare event of a product not being available immediately for delivery, we will contact you with an estimated delivery date and offer the option of a similar item replacement or a refund on that item.
8. Force Majeure
SHED shall not be held liable for any late delivery or non processing of an Order due to war, strikes, industrial action short of a strike, lockouts, accidents, fire, blockade, import or export embargo, ice obstruction, legal restrictions, Acts of God, natural catastrophes or other obstacles over which SHED has no control. In the event of any of the foregoing reasons or for any other reason beyond the control of SHED, we will reasonably try to complete your order within 28 days, if we cannot fulfil this, we shall refund any payments made for non processed orders.
9. Consumer Law
We abide with all of our obligations under the following consumer protection laws currently in place:
The Consumer Protection (Distance Selling) Regulations Act 2000 (DSR's)
The Electronic Commerce Regulations Act (as part of DSR 2000 Act)
The Trade Descriptions Act 1968
The Data Protection Act 1984
The Sale of Goods Act 1979
The Consumer Protection Act 1987
Under the Data Protection Act 1984, you can be assured that SHED will never disclose or sell any information regarding it's clients details to any third parties.
10. Privacy Policy
We do not hold any credit or debit card details or any other form of financial information regarding our customers details, under any circumstances. Orders that are taken over the phone and processed verbally, the customers financial details will be entered directly into PayPal Virtual Terminal and will not be physically or electronically recorded by SHED Men's Health in any way.
We do hold our customers name, address, contact phone number and email address details to assist with our business processes. This limited information is never disclosed to 3rd parties for any reason, under any circumstances. If you would like further information regarding any personal details we hold for you or you would like your details removed from our system, please contact customer services.
11. Invalidity
If any term or provision in this agreement shall in whole or in part be held to any extent to be illegal or unenforceable under any enactment or rule of law, that term or provision or part shall to that extent be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.
12. Jurisdiction
These Terms and Conditions shall be governed by English Law and the parties submit to the exclusive jurisdiction of the Courts of England.
